An automobile accident with injuries or even fatalities can be shattering for the victims and their families. But it can be especially tragic when a driver leaves the scene without even helping other victims or presenting identification. This is a hit and run accident: when a driver is involved in an accident with a pedestrian, another car or a fixed object and leaves the scene without identifying themselves to the police, witnesses or others involved in the accident.
The National Highway Traffic Safety Administration reports that 11% of all accidents are hit and run, making them fairly common. The driver is often driving under the influence of drugs or alcohol and leaves the scene to avoid those charges.
Idaho law on hit and run accidents does not specify fault. Anyone involved in an accident resulting in damage must:
Stop,
Give aid if possible to anyone who is injured,
Call promptly for medical and police assistance, and
Provide identification information including name, address, driver’s license and proof of car registration and liability insurance.
Failure to do so – in other words, to hit and run – is a felony for any injuries or fatalities and can lead to penalties including fines up to $5,000, license revocation and imprisonment up to 5 years.
What to Do if You Are Involved in a Hit and Run Crash
In the aftermath of an accident involving injuries and property damage it may be hard to remain calm, but it’s vital to gather as much information as you can to help your insurance company make decisions about your claim and to help police catch the driver who left the scene.
Write down as much information as you can about the vehicle that hit you: make, model, color, condition, license plate number and state.
Make a note of witness names and contact information.
Include the location and time of the accident.
Take photos of the accident and your car especially if the other car has left paint at the damage site.
Obtain medical treatment for any victims immediately. Never chase a car that you believe was involved to avoid retaliation or being in another accident. Contact police right away and file an accident report.
Filing a Claim against a Hit and Run Driver
Idaho requires that drivers have uninsured motorist (UIM) insurance coverage unless waived in writing. This UIM coverage would apply in the event of a hit and run accident where the at-fault driver is unknown. Your UIM insurance would step into the shoes of the uninsured or missing driver. Be sure to purchase as much UIM insurance as you can afford.
