How to Protect Your Rights After a Bicycle Accident Injury

Most people are familiar with the steps they need to take if involved in a car accident. In fact, most States require reporting to law enforcement after a crash. People are less likely to know what they should do if they are injured whenstruck by a car while they are riding a bicycle.In 2013, an estimated 48,000 bicyclists were injured after being struck by a car. 743 of them died as a result of the crash. If you are in a bicycle crash and still conscious following the crash you should follow these steps.

1.  Call 911. This should be done in order to assure that you receive proper medical care and to have the police or state troopers document the crash and possibly issue a traffic citation to the car driver.

2. Unless you have sustained only a minor bruise, accept the medical help offered by the paramedics, including transportation to a hospital if they recommend this.

3. Make sure you obtain all contact and insurance information from the car driver.

4. Follow the treatment plan recommended by the emergency room physician, and follow up with a visit to your primary care doctor.

Not long after the crash you will probably be contacted by the insurance company of that car driver.  Please keep in mind that claims adjusters are not paid to be your friend.  They are paid to work for the insurance company’s interest, which may or may not coincide with your best interests.  Adjusters get promoted for closing files, not for giving injured people personalized treatment.
